Terms & Conditions
Updated: October 7, 2026

These Advertising Terms & Conditions (“Terms”) apply to advertising purchased from The Sarasota Social LLC (“The Sarasota Social,” “we,” “us,” or “our”). By purchasing, authorizing, approving, or submitting advertising, the advertiser (“Advertiser”) agrees to these Terms.

1. Advertising Services

The Sarasota Social provides local advertising and promotional opportunities that may include placement in our Hospitality Amenities Guides, website, digital platforms, social media channels, QR-code programs, hospitality partner properties, and other promotional media.

Specific advertising services, placement, duration, pricing and any additional benefits are determined by the advertising package purchased by the Advertiser.

2. Advertising Rates

The Sarasota Social currently offers a special Local Business Rate of $299 per year to qualifying businesses located on Siesta Key and within the Gulf Gate area.

Businesses located outside the Siesta Key/Gulf Gate vicinity are subject to our standard advertising rate of $399 per year, unless otherwise agreed to in writing.

Special offers, promotional rates, package pricing or negotiated rates may be offered at the discretion of The Sarasota Social.

3. Advertising Term

Unless otherwise stated in writing, advertising is purchased for the specific advertising period identified on the Advertiser's invoice, order form or agreement.

Advertising does not automatically renew unless both parties separately agree to a renewal.

4. Payment

Payment is due according to the terms shown on the Advertiser's invoice or advertising agreement.

Advertising space is not considered secured until required payment has been received unless The Sarasota Social agrees otherwise in writing.

Failure to make payment when due may result in the suspension, withholding or removal of advertising.

5. Advertisement Design

The Sarasota Social may provide professional advertisement design services as part of an advertising package at no additional charge.

Advertisers may also provide their own completed advertisement, photographs, logos, artwork and other materials.

When The Sarasota Social creates an advertisement, the Advertiser will be given an opportunity to review and approve the advertisement before final production whenever reasonably practical.

Once an advertisement has been approved by the Advertiser and submitted for printing, production or publication, changes may not be possible until a future printing or edition.

6. Advertiser Responsibility for Content

The Advertiser is responsible for ensuring that all information contained in its advertisement is accurate, including but not limited to: business name, telephone numbers, addresses, websites, pricing, promotions, hours of operation, photographs, trademarks, claims and other information supplied by the Advertiser.

The Advertiser represents that it has the legal right to use all logos, photographs, trademarks, copyrighted materials and other content supplied to The Sarasota Social.

The Sarasota Social is not responsible for errors contained in information or materials supplied or approved by the Advertiser.

7. QR Codes & Tracking

Advertisements may include a trackable or redirectable QR code provided or managed by The Sarasota Social.

Depending upon the advertising package and technology being used, QR-code tracking may provide information such as the date and time of a scan, device information, approximate location and other available analytics.

QR codes may direct visitors to an Advertiser's website, Google Business Profile, social media page, promotional landing page or another approved destination.

The Sarasota Social does not guarantee any minimum number of QR-code scans, website visits, inquiries, leads or sales.

8. Distribution & Hospitality Partners

The Sarasota Social works with hotels, resorts, vacation-rental companies, property managers and other hospitality partners to distribute its Amenities Guides.

Advertisers understand that the number and identity of participating properties, accommodations and hospitality partners may change during an advertising term due to circumstances including new partnerships, terminated partnerships, property sales, management changes, renovations, closures or other circumstances outside the reasonable control of The Sarasota Social.

The Sarasota Social may add, replace or discontinue distribution locations while continuing to provide substantially similar advertising exposure.

9. No Guarantee of Results

Advertising results vary significantly between businesses.

While The Sarasota Social's goal is to connect local businesses with Sarasota-area visitors and consumers, The Sarasota Social does not guarantee any specific number of customers, leads, telephone calls, reservations, website visits, QR-code scans, sales or revenue resulting from an advertisement.

The Advertiser acknowledges that advertising involves inherent uncertainty and that payment is made for advertising exposure and services rather than guaranteed business results.

10. Placement & Positioning

The Sarasota Social retains reasonable editorial and production control over the organization, placement and positioning of advertisements within its Amenities Guides and digital platforms.

Unless a particular position, category or exclusivity arrangement has been specifically agreed to in writing, no particular page, position, sequence or proximity to another advertiser is guaranteed.

11. Category Exclusivity

Category or geographic exclusivity is provided only when specifically agreed to in writing by The Sarasota Social.

Any exclusivity agreement applies only to the specific category, geographic area, publication, edition and time period identified in the agreement.

The Sarasota Social may continue working with businesses that provide different or overlapping products or services unless expressly prohibited by a written exclusivity agreement.

This one is especially important for you because you've already discussed things such as restaurant and massage-category exclusivity.

12. Cancellation & Refund Policy

Because advertising space, design work, production resources and distribution capacity may be committed shortly after an advertising agreement is accepted, advertising purchases are generally non-refundable once the advertisement has been approved and/or submitted for production or printing.

If an Advertiser requests cancellation before its advertisement has been approved or submitted for production, The Sarasota Social may, at its discretion, issue a full or partial refund depending upon work already completed and costs incurred.

No refund will be issued solely because an Advertiser does not receive the level of customer response, leads or sales it anticipated.

13. Printing & Production Variations

Advertisers acknowledge that minor variations may occur between digital artwork and printed advertisements, including differences in color, trimming, positioning, image reproduction or other normal printing and production variations.

Such minor variations do not constitute a defect or grounds for a refund.

14. Right to Refuse or Remove Advertising

The Sarasota Social reserves the right to refuse, suspend or remove advertising that we reasonably determine: is unlawful, fraudulent, misleading or offensive; infringes intellectual-property rights; contains materially inaccurate information; could damage the reputation of The Sarasota Social or one of its hospitality partners; or is otherwise inconsistent with the standards of our Amenities Guides.

When reasonably possible, we will work with the Advertiser to resolve the issue before removing an advertisement.

15. Third-Party Businesses

The Sarasota Social promotes independent businesses but does not own, operate, manage or control those businesses.

The Sarasota Social is not responsible for the products, services, actions, omissions, pricing, availability or customer experiences provided by an Advertiser or other third party.

16. Limitation of Liability

To the fullest extent permitted by applicable law, The Sarasota Social shall not be liable for indirect, incidental, special, consequential or lost-profit damages arising from an advertising agreement or advertising campaign.

To the fullest extent permitted by law, The Sarasota Social's aggregate liability arising from an advertising purchase shall not exceed the amount actually paid by the Advertiser to The Sarasota Social for the advertising giving rise to the claim.

17. Events Beyond Our Control

The Sarasota Social will not be responsible for delays, interruptions or inability to perform caused by circumstances reasonably beyond our control, including hurricanes, tropical storms, natural disasters, government orders, power or internet outages, printing or supply-chain interruptions, property closures, hospitality partner closures or other similar events.

Given that you're operating on Siesta Key, I would definitely keep the hurricane/natural-disaster language.

18. Electronic Communications & Acceptance

The Advertiser agrees that advertising agreements, approvals, invoices, notices and other business communications may be conducted electronically.

Approval may be documented through electronic signature or other electronic records where legally permitted.

Florida law generally recognizes electronic records, contracts and signatures and provides that a signature or contract cannot be denied legal effect solely because it is electronic. Online Sunshine

19. Governing Law

These Terms and any advertising agreement with The Sarasota Social shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute arising from these Terms or an advertising agreement shall be brought in a court of competent jurisdiction located in Sarasota County, Florida, unless otherwise required by applicable law.

20. Changes to These Terms

The Sarasota Social may update these Terms from time to time.

Changes will apply prospectively and will not materially alter an existing paid advertising agreement during its stated term unless agreed to by the Advertiser or required by law.

21. Entire Agreement

These Terms, together with the applicable invoice, order form, advertising agreement and any written special terms agreed to by The Sarasota Social and the Advertiser, constitute the agreement between the parties concerning the advertising purchased.

If a specific written advertising agreement conflicts with these general Terms, the specific written agreement will control with respect to that advertising purchase.
